Equal Justice. More For Some Then Others

Mail.com--- In 2009 a multimillionaire Du Pont family heir was spared jail for raping his three-year-old daughter because judge decided he would 'not fare well' behind bars--- "According to the lawsuit filed by Richards' ex-wife, he also admitted to sexually assaulting his infant son in addition to his daughter between 2005 and 2007."

You know what they say. Justice is fair. It's just that it's more fair for the wealthy. District Attorney offices are limited by having to stay within their budgets. Some defendants have more money then the entire prosecutors office. District Attorneys get their jobs by being elected. It doesn't necessarily mean they are the best and brightest legal eagles like those who go into private practice which can make 10x's the money if they're extremely good at what they do.

Which would you rather?
A team of lawyers like he used or one court appointed attorney?


It's been said sometimes when rich people violate the law they suffer from "affluenza". A condition which causes them to make "mistakes". Poor people on the other hand have no such affliction. Since there's no such defense as that which would apply to only the more affluent among us, these are more likely to end up a guest at the no-tell hotel.

Apparently the judge felt this guy would not fare well behind bars. It would be really interesting to see, if in any of his past rulings, he felt the same way anytime before this one. Were there any other defendants since then he left off the hook feeling they wouldn't fare well behind bars either? If not, why not?

There's no excuse for letting this guy off the hook any more then it would be for a judge to excuse someone pleading 'ignorantia juris non excusat'.
